Terms & Conditions

1.  About these Terms and Conditions

1.1. These terms and conditions apply to any contract between you and Spectrum Kids Fitness in respect of your and your child’s participation in any activity provided by Spectrum Kids Fitness.

1.2. Please read these terms and conditions carefully before registering for an activity through the website or on social media.

1.3. Please note that before registering for an Activity through the website, social media, phone or otherwise you will be asked to accept these terms and conditions. By making a booking, paying, and confirming a place within an activity you are confirming your agreement to be bound by these terms and conditions. If you do not want to accept these terms and conditions, You will not be able to register for an activity with SKF.

2. About Your Contract

2.1. In registering for any activity provided by SKF, you are entering into a legally binding contract with SKF. This contract, and your obligations under it, will conclude upon your completion of the activity partaking. 

2.2. For the purposes of these terms and conditions, “you” means the person identified as the participant or parent/legal guardian of any minor (under 16 years of age) registering to take part within a SKF (and “your” shall be construed accordingly). “ SKF” means Spectrum kids Fitness.

 

3. Terms Used

3.1.  “Activity” means the fitness class provided by SKF. “Equipment” means any equipment a participant will use during an Activity, including any being hired by the participant.

3.2.  “Company Insurance” means insurance obtained by SKF. This includes public liability Insurance.

3.3.  “Specified Location” means the location of each individual Activity.

3.4.  “Specified Time” means the time an Activity begins, as well as the length of time of each Activity provided.

3.5.  “We” means SKF or any employee or representative or associate of SPK (and “our” shall be construed accordingly).

3.6. Unless otherwise notified a “term” is one hour’s class at the same time and day of the week for one calendar month.

 

4. Activity Specifics In-Person Classes

4.1. Timings.  All activities will start and finish on time; there will be no delay in either start or finish.

4.2. Participants Attire.  All participants must wear comfortable and suitable workout/exercise clothing, as well as shoes/trainers.

4.3. Equipment.  Classes involve using equipment supplied by SPK. The Participant acknowledges they shall not be permitted to use any other rebounding product or equipment during classes, unless the Participant takes full responsibility in using equipment, they have provided themselves.

 

5. Booking and the Booking Process
5.1. It is a requirement that all classes are prebooked, please do not attend any class if not booked. Classes are specifically tailored to both the individual child’s needs and wants, and the overall needs and wants of the entire group.  The group dynamics between class members are just as important.  This is why prebooking and early confirmation is essential. 
5.2.  SKF use a membership model, with recurring payments.  Once your first class is booked and confirmed by payment of your first invoice (including deposit), you are considered an active member of SKF.  This guarantees your chosen day and time slot each month for as long as you wish it.
5.3.  Membership is only active when you have verified your payment method with us.  We accept credit and debit card and direct debits.  You will be sent a secure link from our payment provider Bank of Ireland (BOI) Collect.  You will use this link to validate and store a payment card with BOI.  All payment details are securely held by BOI, not SKF.  
5.4.  SKF will charge your stored card for the term fees on the 15th of the month, this will be payment for the term starting on the 1st of the following month (ie you pay roughly two weeks in advance)
5.5.  Only full payment of your fees confirms and guarantee’s your child’s place.
5.6.  In the event of a failed payment, SKF will make all reasonable attempts to contact you. The place will be considered available for sale in the next term and we reserve the right to offer the class to the another customer.    
5.7 New and returning former members are required to pay a fully refundable deposit of €30 for the first monthly class with an additional €10 for each additional class.  For example, two siblings joining for one weekly class each will require a €40 deposit.  This will apply to your first invoice.  This is in addition to the fee for the term. 
The deposit will be refunded to you when you cancel your membership, provided you cancel at least 14 days before the start of next term.  Failure to provide adequate notice will result in the loss of your deposit without exceptions.

6. Cancellations and refunds
6.1.  To cancel your membership, SKF requires a minimum of two weeks’ notice prior to the start of the next term and must be given in writing and left with the coaches or emailed to cancel@spectrumkidsfitness.com.   Please give the name of your child and their class day and time.
If you fail to give the required notice you agree to pay for the upcoming term.  Fees will not be refunded if you decide to leave mid-term.  Verbal notice to coaching staff can be too easily forgotten and is not their responsibility so it will not be considered acceptable notice.
6.2.  We do not offer refunds unless in exceptional circumstances but cannot refund a term once it has started.
6.3. SKF reserves the right to cancel a class at any point once it has begun should the instructor consider a Participant injured or unwell. 
 

7. Your Status and Responsibilities (parent and guardian)

7.1. You will abide by any rules and regulations set by a coach regarding entering and leaving the premises.

7.2. You understand and agree that Your child will participate entirely at your own risk.

7.3.  You will rely on your own ability in dealing with hazards and must take part in a way that is safe to yourself and your child.

7.4.  You are required to inform us before a child starts a class of all medical needs known to you, i.e. asthma, epilepsy, allergies, etc.

7.5. You agree that through the booking process, You are committing to paying for your activity via the means available.

7.6. You accept that all decisions made by SKF and its employees in respect of the wellbeing of your child’s class are considered final. 

 

8. Online Transactions

8.1 We use secure payment facilities for all online purchases provided by Bank of Ireland Collect and GoCardless for direct debits; Your payment details such as credit card details are entered in a secure payment gateway and are not stored by anyone at SKF. 

8.2 The system for taking payments and capturing your entry data is provided by third parties, Bank of Ireland and GoCardless. They are acting as our agent and payments made will initially be to the systems in place before the payment is cleared to SKF.

 

9. Matters Outside of Our Control (Force Majeure)

9.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control (“Force Majeure”).

9.2 Force Majeure includes any act, activity, non-happening, omission, or accident beyond our reasonable control and includes (without limitation) the following:

9.3. fire, explosion, storm, flood, earthquake, inclement weather conditions, subsidence, epidemic or other natural disaster.

9.4 sabotage of the premises or deliberate vandalism of the premises resources and equipment

9.5 In such circumstances We will, if possible, provide notice of cancellation to You.

 

10. Variation to these terms

10.1. SKF reserves the right to vary these terms and conditions to reflect changes in relevant laws and regulatory requirements. Any such variation shall become effective immediately upon posting on the website and our social media platforms. 

 

11. Entire Agreement

11.1. These terms and conditions (and the documents referred to in them) constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the Activity.

 

12. Third Party Rights

12.1. No person other than You and SKF shall have any rights to enforce these terms and conditions.

 

13. Personal information

13.1. We are committed to protecting the privacy and confidentiality of information provided by all Participants. Accordingly, SKF upholds the relevant data protection principles and processes personal data in accordance with the Data Protection Act 2018. 

 

14. Media Use Rights Permission

14.1. We ask parents/guardians to grant permission for children to be involved in photographs and videos in an active class. No personal information is ever used or linked to the photographs, ie names of children or times of classes.

We ask for full rights to use the images resulting from the photography/video filming, and any reproductions or adaptations of the images for fundraising, publicity, or other purposes to help achieve the group’s aims. This might include (but is not limited to), the right to use them in their printed and online publicity, social media, press releases.
